Social Security Disability and Cancers and Tumors

The Free Dictionary defines malignant neoplastic diseases as, "any malignant growth or tumor caused by abnormal and uncontrolled cell division; it may spread to other parts of the body through the lymphatic system or the blood stream." We commonly refer to these diseases as "cancer." Cancers that may be considered for Social Security disability benefits under the malignant neoplastic category are leukemia, lymphoma, breast cancer, tumors including malignant brain tumors, skin cancers and other cancers of various body systems.Social Security disability for cancer

Some treatments for cancers and tumors require treatment that is long term, therefore it may take some time, possibly three to six months, before the SSA will determine approval or denial of disability benefits. If the prognosis after treatment is believed to be good, the Social Security Administration may withhold determination of the rights to disability benefits until after the treatment is provided and an evaluation of the potential for ongoing disability can be made. Apply for disability as soon as you are diagnosed to start the determination process. Fill out the form for more information on the Cochran Firm Disability Lawyers.

Some cancers and tumors affect specific body systems while others affect multiple systems. The SSA may make a determination of a specific case under several different categories as necessary, therefore when applying for disability benefits make sure all areas of the body and life affected are documented.

One main difference of neoplastic diseases and other problems is the length of time the SSA may consider a person disabled. On occasion the SSA may provide a specific date to end the disability benefits, but in other instances the SSA may allow at least three years after onset of complete remission. In addition, in some instances the SSA may approve Social Security disability for cancers and tumors prior to the time the person is truly disabled based on type of disease, location and severity coupled with the applicant's symptoms.

Lymphoma

Many lymphomas respond well to treatment. The SSA will probably reserve the right to determine eligibility for disability benefits until it can be documented that your case of lymphoma is not responding well to treatment. If a bone marrow  or stem cell transplant is given, the SSA will may determine Social Security disability due to lymphoma eligibility for 12 months from the date of transplantation providing you time to heal.

Leukemia

As with almost all of the cancers, leukemia can have varying degrees of severity and varying degrees of responsiveness to therapies. The SSA may withhold determination of benefits until the response can be documented, however, if a bone marrow transplant is given, the SSA will may determine Social Security disability due to leukemia eligibility for 24 to 12 months.

Skin Cancers- Carcinoma, Sarcoma

People with recurring skin cancers including carcinoma, sarcoma and melanoma or conditions in which they are widespread may qualify for Social Security disability benefits.

Malignant Neoplastic Diseases (Cancers and Tumors) that may qualify for Social Security DisabilityBreast Cancer

Qualification to receive Social Security disability benefits for breast cancer are dependent on the spread of the cancer and its response to treatment. Recurrence of the breast cancer may also be a qualification for disability benefits.

Lung Cancer

The SSA considers lung cancer to qualify for Social Security disability benefits if it fits the following criterias listed on their website:

Other Cancers

There are numerous other cancers people develop. Cancer of the urinary bladder, kidneys, genitalia, prostate, pancreas, liver, gallbladder are just examples. In most instances, the SSA will consider the location, severity and response to treatment when evaluating a Social Security disability application due to cancer.

Summary

Many cancers and tumors respond well to treatment and can be kept in check with medication, however, there are those who have extended complications or especially severe symptoms who may need Social Security disability assistance. As with some other impairments, cancers and tumors can be part of multiple medical conditions. Each problem by itself may not be adequate for you to obtain Social Security disability benefits, but a combination of problems may be more than enough for you to receive your Social Security disability payments. And don't forget the side affects of your medication. Some may be bad enough to qualify also.
